Personal data:
The Site may be consulted without the User having to reveal his/her identity or any other information of a personal nature.
The User expressly agrees that the data of a personal nature concerning him/her collected as part of use of the Site may be processed for the purposes of client relations and commercial management of the Site.

Manitou BF uses all appropriate technical and operational means to protect personal data against accidental or illegal destruction, accidental loss, modification, disclosure or unauthorized access.

Manitou BF keeps personal data no longer than necessary for completing the purposes for which they were collected or processed.

Manitou BF may be required to divulge information concerning the User in order to comply with any applicable law or regulation, or to respond to any legal or administrative request.

This site complies with the revised Law on Data Collection and Civil Liberties no. 78-17 of January 6, 1978

Article 2 – Purpose of the Site

These general terms of use apply to any user (hereinafter called: the User) visiting the www.manitou.com Site and to all of the site and domain names registered by MANITOU BF for representing its company, its products, its services and its network. The purpose of the terms of use is to define the terms, conditions and methods by which access to the site is granted and to the services offered by it. Navigation on the Site implies unconditional acceptance of them by the User. The User is considered to have accepted them, simply by using the site. Any consultation of the site carries with it, without limit or exception, acceptance of the general terms of use in their latest version. MANITOU BF or any subsidiary which may replace it may modify these terms of use of the Site at any time and without prior notice. It is the User’s responsibility to consult this page on a regular basis to stay informed of any possible changes. The User is advised to refer regularly to the latest version of the General terms of use. The User is deemed to have accepted this latest version at each new visit to the site.

The goal of the MANITOU BF S.A. site is:
- to introduce the MANITOU BF company and its subsidiaries
- to present its lines of products and services and its network of dealers
- to make the public aware of information of all kinds (financial data, participation in international trade fairs and shows, etc.).
The Site may change in response to the expectations of its Users. MANITOU BF may modify the contents of the Site and disable certain of its functions at any time and without prior notice without liability on the part of MANITOU BF for any consequences of such modifications for the User.
 

Article 3- Contents of the Site – Liability

All information posted on the Site is meant solely as a descriptive presentation of the activities of MANITOU BF.
MANITOU BF does not guarantee the accuracy, fullness, or the updated nature of the information presented on the site. MANITOU BF or any subsidiary which may replace it may not be held liable for the interpretation, exhaustiveness, completeness and updating of the data and information contained on this site. Any documentation other than these General Terms of Use and on any media whatever, such as brochure or catalog issued by the site is only for descriptive purposes.
The information, products and services presented may undergo modification at any time and without prior notice without liability on the part of MANITOU BF for any consequences of such modifications. Manitou BF is responsible for the site. However, the User hereby accepts that any subsidiary may replace MANITOU BF at any time in providing the service or services available on the site.

In no event may the liability of MANITOU BF or of any subsidiary which may replace it be invoked for any damage, of any kind whatsoever, resulting directly or indirectly from the use of the Site, such as, but not exclusively, from a virus which could damage or disable the User’s computer equipment.
The User promises not to disrupt the operation of the site and not to use the communication services in an inappropriate way.
The User promises to use the Site or its contents in accordance with national and international regulations and so as not to injure the reputation of MANITOU BF.

Article 4 - Employment Opportunities:

There is a space called “applications” where the User may access job offers for positions available at Manitou BF or one of its subsidiaries and apply for these offers.
The information requested from the User at the time of inputting his/her contact information or CV are essential for the proper operation of the system and processing of one’s application. Data is kept for 12 months after the latest contact. This information is for the exclusive use of Manitou BF or its subsidiaries.
MANITOU BF or any subsidiary which may replace it cannot guarantee the User that all positions mentioned in this web site still exist or are available.
The fact that the User-applicant has posted an application implies no obligation on the part of Manitou BF or any of its subsidiaries as to the result or process of employment.
The User submitting an employment application promises that all information submitted (education, employment history …) is accurate.
 

Article 5 – Access to the site – Use:

Users acknowledge that they are properly equipped, specifically in terms of computer, telecommunications and security, to access and use this site.
MANITOU BF does everything in its power to make the site accessible 24 hours a day and 7 days a week. However, testing, monitoring and maintenance activities, as well as interventions required for emergency repairs, may be made by MANTOU BF at any time. Thus, Manitou BF reserves the possibility of closing or restricting access to all or any part of the Site for maintenance operations or at the request of any legal authority and in cases of force majeure. MANITOU BF will make every effort possible to notify the User in advance of the occurrence of such events.
All equipment, communications, telecommunications and other expenses and costs necessary for the connection to and use of the site, as well as all necessary authorization pertaining thereto, are the responsibility of the User.

Article 6 - Intellectual property

The Site and its contents are the property of MANITOU BF or are duly authorized for use by it, concerning its general concept as well as its software, artwork, data banks, design, photos and images, text, drawings, sounds, and all other creations making up the contents of the Site. Any representation or reproduction, in whole or in part, of the Site, whether remunerated or free of charge, without prior written permission from MANITOU BF, the author or publisher, or any beneficiary or successor thereof is forbidden, except as strictly needed for on-line consultation.
The brands and logos appearing on the Site are registered trademarks. In particular, the brand names MANITOU, BRAUD & FAUCHEUX, BUGGIE, MANITRANSIT, MANIHOE, MANILEC PRODUIT BLANC, MANIACCESS, MANILOADER, MANITOU FINANCE, GEHL and MUSTANG belong to MANITOU BF or its subsidiaries. All reproduction, use, imitation, insertion, elimination or modification of these items without prior written permission from MANITOU BF or one of its subsidiaries is forbidden and constitutes an act of infringement punishable by law.
In compliance with the provisions of law no. 98-536 of July 1, 1998, on implementation in the code of intellectual property of directive 96/9 EC of March 11, 1996, concerning the legal protection of data bases, MANITOU BF is the producer and owner of all or part of the data bases making up this site.
The User promises strictly to observe this right of intellectual property.

Article 7 –Hypertext Links

4.1. Hypertext links to the Site:

The creation of any hypertext link on external Internet sites pointing to the Site is forbidden without prior written permission from MANITOU BF S.A..

4.2. Hypertext links from the Site

The Site may contain hypertext links to other sites (“third-party sites”). MANITOU BF has no control over these third-party sites which are administered independently by their operators. Consequently, MANITOU BF may not under any circumstances be held liable for any harm to the User resulting from access to a third-party site by activation of a hyperlink on the Site.

Article 8 – Cookies

In order to serve the Users of the Site better, MANITOU BF may automatically install “cookies” on their Internet browsers. Cookies allow MANITOU BF to record information about Site navigation which is entirely anonymous.
The User may block recording of cookies by configuring his/her Internet browser software according to the publisher’s instructions.

Article 9 – General Provisions

These general terms of use of the Site are subject to French law. Where there exist general terms of use both in the French language and in a foreign language, only the French language version will define the legal relationship between the Parties and will be used in the event of divergences of interpretation.
In the event of objections on the interpretation, execution or fulfillment of any one of their stipulations, and lacking mutual agreement between the parties, any dispute related to the use of the Site will fall under the exclusive jurisdiction of the courts of Nantes (France).
